Minutes:
CALL TO ORDER:
The legislative meeting hosted by the Utility Notification Center of Colorado was held on the 12th day of January 2006, at 16361 Table Mountain Parkway, Golden, Colorado. J.D. Maniscalco called the meeting to order at 9:00 a.m. and welcomed attendees to the fifth meeting. J.D. thanked attendees for coming to the UNCC facility. He noted that the group is gaining momentum and has had good discussions with agreements beginning to take place for the good of the industry. J.D. stated that UNCC is limited by law and the direction of the Board of Directors from lobbying on behalf of any legislative issues. Any draft legislation must come from the group as representatives of their areas of the industry. The objective of any legislative changes will be to have a safer industry and to better the one call system. J.D. briefly reviewed the document prepared by UNCC for the membership group regarding Tier II and Tier I membership costs. The enforcement group’s work is essentially complete but they will meet to further discuss the enforcement law from Virginia. Contractors present agreed to provide representation in each group meeting.
BREAK OUT SESSIONS:
Groups met separately to discuss membership issues, exemptions to the law and enforcement and penalties.
GROUP REPORTS:
Exemptions: Dave Miller (Larimer County Road and Bridge Department)
The exemptions group reviewed and revised the survey document. It will be sent to UNCC members and given to the CCA for distribution to excavators. David Fiore suggested they also contact the ASA and the Demolition Contractors Association for distribution.
Enforcement: David Fiore (Fiore & Sons, Inc.)
The enforcement group reviewed the Virginia enforcement law for language that can be adapted for Colorado. Virginia’s enforcement process is facilitated by Virginia State Railroad and Safety. David reviewed some aspects of penalties provided for in the Virginia law. They elect a commission that includes a broad based pier group to review the process. The group still has not determined an entity to facilitate the enforcement process for Colorado. Discussion was held regarding setting up a separate arm of UNCC to facilitate the process or approaching the Colorado Department of Public Safety for facilitation. All funds generated by the enforcement process would be used to facilitate the process. Federal funding may be available to establish the process with future fines used to continue to support the work of the advisory committee. David agreed to provide a copy of the Virginia law for the meeting record and group review.
Membership: J.D. Maniscalco (UNCC)
The Tier II representatives in the membership group have stated that they do not feel that Tier I membership is an option for most Tier II members. The group reviewed the UNCC membership cost document. They discussed what kind of financial support for UNCC might be agreeable to Tier II members. Discussion included a flat rate usage based on previous years experience at levels of usage outlined by the group as follows:

101 - 500
501 – 1,000
1,001 – 5,000
5,001 – 25,000
25,001 – 100,000
Over 100,001
It became clear that determining the numbers of existing Tier II members in each category would be needed to establish any fees. This information will be prepared by UNCC for the next meeting. The group discussed whether payment of a fee of this kind would mean that UNCC would provide the Tier II members with ticket information and no agreement was reached on this issue. Limiting provision of this type of membership fee to governmental agencies was also discussed.
CONCLUSION and NEXT MEETING:
The next legislative meeting will be held on Friday, February 10, 2006 at 9:00 at Utility Notification Center of Colorado at 16361 Table Mountain Parkway, Golden, Colorado.
